RUHLE V. RUHLE
Henry Phillip Ruhle, of Pittsworth, labourer, petitioned for the dissolution of his marriage with Lena Elizabethi Kupfer (of Pittsworth), on the ground of her alleged misconduct with George Parson Faux, who was joined as co-defendant. Petitioner submitted evidence that the marriage took place at Pittsworth on July 9, 1913, according to the rites of the Methodist Church and that the parties had lived together at Pittsworth until March, 1922. There were five children of the marriage, of which four survived, the custody of which was asked for by the petitioner.
Mr. E. A. Douglas (instructed by Messrs Chambers M'Nab and M'Nab, agents for Mr. B. J Beirne of Toowoomba) appeared for the petitioner. There was no appearance for the defendant or co-defendant.
Henry Phillip Kuhle, the petitioner, said that long before the final break he had objected to his wife's liking for Faux. His wife left him in March, 1922, and went to live with Faux. January 1923, she had a child of which Faux acknowledged the paternity.
Confirmatory evidence was given by other witnesses.
His Honour found the allegations of misconduct proved and granted a decree nisi, returnable after three months. The petitioner was granted the custody of the children, and costs were given against the co-defendant.

HUSBAND SEEKS DIVORCE.
Henry Phillip Ruhle, a laborer, of Pittsworth, asked Chief Justice M'Cawley yesterday to grant him a dissolution of his marriage with Lena Elizabeth Ruhle (nee Kupfer, of Pittsworth), on the grounds of her misconduct with George Parson Faux, of Pittsworth, who was joined as co-defendant There was no appearance of defendant or co-defendant.
The parties were married on July 9, 1913. There were five children. It was stated that the parties lived happily together until 1919, when the co-defendant, who had been to the war, returned to Pittsworth. Defendant, obvious of petitioner's strong objections, persisted in going out with Faux. In March, 1922, defendant left petitioner's farm at Greendale for Pittsworth, and as she did not return that night he followed her to Pittsworth, and found her at the home of co-defendant's mother. "I prayed of her," said petitioner, "to return home, if not for my sake, for that of the children." She blankly refused, saying: "This is my home now."
Petitioner further alleged that defendant misconducted herself with the co-defendant at Toowoomba during the months of March, April, and May, 1922, and since had cohabited continuously with the co-defendant. In January 1923, defendant gave birth to an illegitimate child, of whom co-defendant was the father.
A rule nisi, returnable alter three months, was granted, with costs against the co-defendant. An order for the petitioner to gain custody of three children was also made.
